The Federal High Court in Abuja has rejected an application by former Kaduna State Governor Nasir El-Rufai seeking a review of his bail conditions in his ongoing alleged wiretapping trial.
Justice Joyce Abdulmalik ruled that the existing bail requirements remain valid, dismissing the defence’s request to vary conditions that require sureties who are Level 17 civil servants with properties in Abuja’s Maitama or Asokoro districts, alongside attestation letters from the Kaduna State Traditional Council.
During the proceedings, the Department of State Services (DSS) formally closed its case, with prosecuting counsel informing the court that the agency would not be presenting additional witnesses.
In response, El-Rufai’s legal team announced plans to file a no-case submission, arguing that the prosecution has failed to establish sufficient evidence to warrant the defendant entering a defence.
The court subsequently granted both parties two weeks to file the necessary legal processes and adjourned the matter until September 22, 2026, when arguments on the no-case submission will be heard.
A successful no-case submission could result in the dismissal of the charges without requiring the defendant to open his defence, while a rejection would require the trial to proceed to the defence stage.
